THE gentleman referred to in your article "Engineer refused to pay damage to wheelclampers" has my full support in his actions. Some companies are taking money from people who do not fully understand their rights.
Having had a similar run-in myself, my advice to people is to ensure that the operative has an identification badge issued by the Security Industry Authority who regulate wheelclampers, take down his or her name and number then check it at www.the-sia.org.uk. This will confirm whether the person clamping is registered and therefore has a legal right to do so.
My own experience showed that the operative who clamped me was not registered by the SIA making his action unlawful. The company itself was not on the SIA approved contractor scheme as at January 26, 2007. If more people challenge wheelclampers and their actions and report unregistered operatives to the SIA, there might not be so many unfortunate clamping incidents.
