A PENRYN man arrested on suspicion of causing the death by dangerous driving of teenager Kathryn Price has been told by the police that he will not face prosecution.
Brett Ralph, aged 23, of Glasney Place, was due to answer police bail last week following the death of 15-year-old Kathryn in an accident on the Penryn by-pass on August 13 last year.
But the police Criminal Justice Unit decided there was "insufficient evidence" to bring a successful prosecution. He was never actually charged with the offence and it is understood he denied being responsible for the accident.
Police spokesman Baxter Provan confirmed that the police were not pursuing any further lines of inquiry.
"Following a study of the evidence by the Criminal Justice Unit it has been decided there is insufficient evidence to convict on causing death by dangerous driving," he said. "Consequently the man arrested has been told he no longer needs to answer police bail."
The news has been greeted with dismay by Kathryn's family which is now unlikely to see anyone being prosecuted over the death of their daughter.
Her mother, Alicia, said a prosecution over Kathryn's death would have bought some kind of closure and it was bitterly disappointing that nobody was going to be charged.
The family was told in a letter from the Crown Prosecution Service that identification of the vehicle thought to have caused the accident could not be proved.
"The police have done a fantastic job with a lot of manpower invested in the investigation," she said. "Kathryn was an innocent party in all this and it is just hard to accept that nobody's going to be prosecuted for her death. We are bitterly disappointed. A prosecution would have bought a bit of closure - her death is still really raw."
She said last Friday would have been Kathryn's 16th birthday and over 40 bunches of flowers and cards had been placed on her grave.
Following Kathryn's death, a police investigation was launched with appeals for information concerning the owners of a number of vehicles. On August 18, Mr Ralph was arrested on suspicion of causing death by dangerous driving and later released on police bail.
The accident that killed 15-year-old Kathryn also left the driver of the vehicle, 20-year-old Steven Harris, with severe injuries. He still has not fully recovered.
The funeral of Kathryn was attended by hundreds of people who blocked the main street through Penryn on their way to the church from the family home in Fox Stanton Drive. A cross and flowers planted by the family mark the spot on the A39 by-pass where Kathryn died.
