A FALMOUTH man who admitted to drink driving while out of county has been sentenced by magistrates at a court in Cornwall.

Simon Palmer, 35, of Malborough Road in Falmouth, appeared in front of magistrates at Truro Magistrates' Court on Tuesday March 8 on one count of driving a motor vehicle when alcohol level above limit.

The offence took place while Palmer was in Devon on January 8 2022 where he was found driving on the A30 in a westbound direction with a level of alcohol in his breath above the legal limit, namely 125 microgrammes of alcohol in 100 millilitres of breath.

Palmer pleaded guilty to the offence when he appeared in court last month.

At his sentencing, magistrates made Palmer the subject of a community order and was made to take part in a rehabilitation activity for a maximum of six days.

He was also made to carry out unpaid work for 120 hours within the next twelve months and disqualified from holding or obtaining a driving licence for 30 months.

The court also told Palmer that his disqualification could be reduced by 30 weeks if by December 2023, he had satisfactorily completed a course approved by the Secretary of State.

Palmer was also made to pay a surcharge to fund victim services of £95 and pay costs of £85 to the Crown Prosecution Service.

His driving record was endorsed and the court also noted how Palmer's guilty plea had been taken into account when imposing the sentence.
