A MAN who breached a criminal behaviour order to steal a bottle of whiskey has been sentenced by magistrates in Cornwall.
Kelvin Pennington, aged 36, of no fixed abode but listed as dwelling in Truro, appeared in front of magistrates at Truro Magistrates' Court on Wednesday, September 13, 2023, on one count of theft from a shop and one count of breaching a criminal behaviour order.
The offences took place on Wednsday, August 16, 2023 in Liskeard where Pennington stole a bottle of Busker whiskey, costing £25, from a Co-op store.
The offence was a breach of a previous criminal behaviour order that had been made by Bodmin Magistrates Court on June 9, 2023.
Pennington pleaded guilty to both offences.
During his sentencing, Pennington was handed down an eight-week custodial sentence, suspended for 12 months, with the court noting that the offence had been so serious due to the nature of the breach and Pennington's record.
Pennington was also made to pay £22.50 in compensation. He must also pay costs of £85 to the Crown Prosecution Service as well as a victim surcharge of £154.
The court noted how Pennington's guilty pleas had been taken into account when imposing the sentence.
