A man has been effectively banned from entering Falmouth town centre as one of a number of terms made in a criminal behaviour order.
Michael David Richards, from Bodmin, must also leave any pub, restaurant or shop when asked, and not stand or sit outside one.
The order against 46-year-old Richards, of Treningle View, Bodmin, was made on August 22 this year by Cornwall Magistrates’ Court, with a variation hearing heard by magistrates in Bodmin on August 31. It will now last until August 21, 2026.
The full terms of the order issued by the court state that he must:
1. Not enter the area known as Falmouth Town Centre (shown on a map provided to him), except to pass through on public transport or to attend a professional's appointment for which he can provide proof of a prior written appointment.
2. Not refuse to leave any public house, restaurant, shop, supermarket, takeaway establishment, shopping centre or any other commercial premises when asked to leave by a member of staff, owner, or security guard.
3. Not enter any public house, restaurant, shop, supermarket, takeaway establishment, shopping centre or any other commercial premises which he knows he has been banned from entering.
4. Not stand or sit outside any public house, restaurant, shop, supermarket, takeaway establishment, shopping centre or any other commercial premises, except when queueing or waiting for an order.
5. Not refuse to leave the area outside any public house, restaurant, shop, supermarket, takeaway establishment, shopping centre or any other commercial premises once asked to leave by a member of staff, owner or person responsible for the premises.
6. Not act in a manner that causes any other person to fear for their safety.
The criminal behaviour order came at the request of the police.
It was issued under section 27 of the Anti-social Behaviour, Crime and Policing Act 2014.
