One of the defendants accused of sexual assault in Helston told police “I’m not a forceful man” while the other said he was left “flabbergasted” by allegations against them.

Day four of a trial into alleged sexual assault on the steps of St Michael’s Church in Helston last year heard transcripts of police interviews with both men.

Before Truro Crown Court are Calvin Rosevear, from Mullion, and Joe Skewes, from Helston, both now aged 40.

They are charged with a total of six offences relating to an alleged incident in Helston during the early hours of July 9 last year.

Rosevear is charged with rape involving penetration of the mouth, and additionally with sexual assault.

Skewes is charged with three counts of sexual assault and one of assault by penetration using fingers.

Both men have pleaded not guilty to all the charges.

Transcripts of interviews carried out by police with Rosevear and Skewes independently were read out to the jury.

In them, Rosevear described his level of intoxication on the night in question as a “six out of ten” and Skewes a “five or six.”

The court was told that before heading into town that night they had drinks with family members and friends first.

After being in the Beehive for around 45 minutes they left to have a cigarette, sitting on the steps by the museum and cannon.

In his police interview, Rosevear said: “We noticed there was a girl and another bloke. He left and she came over and started talking to us.

“She was a good laugh. She was upbeat. She was being very flirty and we said ‘Do you fancy a bit of fun with us?’ She was like ‘Absolutely’.

“She got on the phone and started texting her friends. She said ‘I’ve got to tell my friends first and away we’ll go’.”

Later in the interview he added: “If it was a no she would have walked up and back, she wouldn’t have come with us. It wasn’t me dragging her by the arms. It was amicable.”

He said the woman was speaking “completely clearly,” adding: “I’m not going to go home with a f***ing drunk girl. I don’t need to do that. I’m a good looking man; I can get dates and enjoy myself. I don’t need to be a f***ing stalker.

“She came and sat down next to us. I think I put my face in her breasts. There was no pushing me away. It was consensual.”

And he went on to add: “All she had to do was walk up the steps. She didn’t have to come with us. She was absolutely fine, no stumbling all the over place.”

When told the complainant had been described by a third party as “out of it and confused,” he said: “If a drunk person is going to be that inebriated she would be all over the place. If she was that drunk I wouldn’t have even been talking to her.”

Rosevear said they walked to the steps of St Michael’s Church, where he lay down and they started kissing and “fumbling around,” explaining she got his penis out and put it in her mouth, later adding that he was also “fondling” her breasts.

“Then two other people, a couple, came from behind us over the steps. They started saying to [the complainant] ‘Are you OK?’. I think she said ‘I’m fine’. She seemed very embarrassed by all this.”

He said the complainant was not crying at all. The couple left but returned and “basically dragged [the complainant] down the steps and away she went,” added Rosevear, who went on to describe the actions as “massively consensual.”

“There were no ‘noes’. If there were any noes I would have stopped completely. I’m a gentleman. I’m not a forceful man.

“I was totally shocked by the way it happened. It was all ‘Yes, yes, yes’. It was going to be a bit of fun. I didn’t think or expect it would lead to me being here. It’s just very bizarre, you know?”

In his interview with police, Joe Skewes told police that he and Rosevear had stopped in the Wendron Street car park to do a line of cocaine before walking into town.

He said of the moment they had first met the complainant: “Calvin is just straight up to her saying ‘Would you like a threesome?’ I couldn’t believe it when she just said yes.”

When asked if this is something Rosevear had done before, Skewes replied: “We’ve never had a threesome before. It’s just Calvin isn’t it? It’s just a thing he’d say,” before going on to add: “All I know is Calvin asked her for a threesome and she 100 per cent said yes.”

Skewes said there had been a conversation about where to go and both the men’s houses were ruled out, adding: “We were walking up to the churchyard and ended up there.”

He described Rosevear lying down and the woman giving him oral sex, while he [Skewes] was behind her “rubbing her.”

He denied removing her underwear, saying he simply pulled it to one side.

Skewes was told by the detective interviewing: “She’s stated she said no three times,” to which Skewes replied: “If she said no we wouldn’t do it. Why are we going to prey on some young woman?”

The detective continued: “She was saying ‘Get off’ do you remember that?” with Skewes replying: “No she definitely didn’t say get off.”

The officer added: “She’s saying Calvin forced his penis in her mouth,” to which Skewes replied: “Why is she saying this? Is she a bit embarrassed? I don’t understand why she’s saying this.”

When asked about the moment two passersby came across the trio on the steps, Skewes recalled: “They started saying something like, ‘The police are on their way’. I don’t remember exactly. Me and Calvin were flabbergasted, like ‘What have we done wrong?’.”

The court also heard that the time between the three leaving the museum steps and the time the complainant returned to the Beehive was around 19 minutes in total.
