A persistent offender ended up being sent back to prison just six days after his release when he kicked an anti-social behaviour officer. 

Oliver Eatwell, 33 aged 33 from Malpas, was sentenced to two months in prison at Truro Crown Court on Friday (July 26) for assaulting an emergency worker and breaching his community behaviour order.

On March 5, Eatwell was spotted in Marks and Spencer in Truro, despite a court order prohibiting him from entering the store. Upon being noticed, Eatwell fled and ran down the slipway from the town centre towards Tesco.

He was arrested for breaching a community order, but then was further arrested after kicking anti-social behaviour officer Steven Lennon in the leg, causing him to fall. Eatwell was subsequently arrested for assault on an emergency worker.

The court heard that Eatwell has a history of offending, including convictions for common assault, battery, and theft. He was released from prison on February 29, 2024, but was recalled on March 6 after breaching his community behaviour order.

In a statement read out in court, the victim, Officer Lennon, said, "I do not come to this job to be assaulted, I do it to help people. Mr Eatwell needs help."

Judge Simon Carr acknowledged Eatwell's autism condition, stating: "I have every sympathy for the autistic spectrum." However, he emphasised that Eatwell's support package required his cooperation.

Judge Carr sentenced Eatwell to one month in prison for breaching his community behaviour order and one month for the assault on an emergency worker, resulting in a total sentence of two months.
